  7. Data about race / ethnicity / religion / disability / gender and self-identified LGBT status, for purposes of government reporting where required, as well as to understand the diversity characteristics of the Atain’s workforce.

By submitting your information, you acknowledge that you have read and understood the foregoing and consent to the use of your information as set out below. You are not mandated to provide any requested information to Atain, but failing to do so may result in not being able to continue your candidacy for the job for which you have applied given that, as your prospective employer, there is certain data that we require to fulfil our obligations in the fields of employment, social security and social protection law as applicable and there is certain information we require to enter into and fulfil an employment contract with you. What will Atain do with your personal data?

Atain will use your personal data to:

  1. Assess your suitability for employment for the role for which you are applying, as well as future roles that may become available;
  2. Perform administrative functions (e.g. reimburse you for interview-related expenses);
  3. Perform analysis of its applicant pool in order to better understand who is applying to positions at Atain and how to attract top talent;
  4. Perform any legally-required reporting or otherwise carry out the obligations required of us in the field of employment, social security or social protection law (as applicable), and respond to legal process; and
  5. In some cases and where we have performed a risk assessment and concluded that there is no other more intrusive method of monitoring and processing such data, record your online interview for review by additional recruiters and hiring managers. In such cases, Atain will seek your explicit consent to be recorded.

Further, if you join Atain’s Talent Network, subject to your separate and explicit consent it will enter you into a database to receive future mailings about Atain’s new positions and events.

Ensure that you provide your contact information (only) at https://atain.azurewebsites.net/careers/ /—a site that Atain maintains to notify you about new positions that may be of interest to you. Your contact information may be used by Atains to send you invitations to sign up for future position alerts and invitations to its recruiting events. We will ask you to give your consent for this on submission of your personal data; after reviewing this policy, you will be asked to tick a box indicating your agreement to the following statement: “I would like Atain to contact me in relation to career opportunities and events that may be of interest to me“. You may opt-out of receiving messages and alerts at any time if you choose and we will notify you of this in our subsequent communications with you.

From what sources will Atain obtain your personal data?

Atain may obtain data about you from the following sources:

  1. From you, when you submit resumes or other information online;
  2. From conversations with recruiters and interviews with hiring managers and other Atain personnel or representatives, some of which may be recorded (with your express knowledge and consent and following consideration by us of the risks of such monitoring method to your rights and freedoms and whether there is a less intrusive method available) as well as from Internet searches that these individuals may perform, or data that they may obtain from job search or professional networking websites (e.g. naukri.com, LinkedIn, etc.) where you may have made data about yourself publicly available;
  3. From third-party recruiters, staffing companies, or websites where you are introduced to Atain. We do not accept unsolicited resumes from 3rd party recruitment agencies, but we sometimes use such agencies, subject to a written agreement. Any resume or other candidate information submitted outside of established candidate submission procedure (including through the Careers website or via email to any Atain employee) and without a written agreement or otherwise will be deemed to be provided for Atain’s use, and no fee will be paid should the candidate be hired by Atain; and
  4. From background checks, as applicable. Where permitted by law, Atain may contract with a third party to perform a pre-employment background screening. The content of background check information shall be in accordance with UK applicable laws, but may include information gathered from publicly available sources, your former employers or colleagues, schools you have attended, credit reporting agencies, and criminal records databases. These types of information will only be collected with your prior consent and, where applicable, in order to fulfil our obligations and exercise our specific rights in the field of employment, social security and social protection law, and you will receive more information about the nature of such a background check including the lawful bases for processing such information where not covered by this policy before it begins. Where required by applicable local law, you may be asked to provide certain background check information (which may include sensitive data) directly to Atain.
Who will have access to your personal data? Where are they located?

In general, access to your personal data will be restricted to minimize the number of people in Atain Network (including Atain Group companies and their related entities.) who need it in order evaluate your application for employment, perform functions supporting our HR and GRO function, or to whom Atain is compelled to provide it by applicable law.

Personal Data may be transferred to a country other than the one in which you reside, which may not have the same legal protections for personal data in the UK. Atain will, however ensure an adequate level of protection of the data being transferred to that under UK GDPR.

The following categories of individuals will have access to your personal data:
  1. Recruiters within the UK. Such individuals may be based in a different country and will be subject to the transfer safeguards mentioned above;
  2. Hiring managers and other interviewers. Often these individuals will be based in the country where the position is based, but in some cases they may be located in other countries and will be subject to the transfer safeguards mentioned above;
  3. The global Atain’s Talent Management teams, consisting of a limited number of individuals based in several countries;
  4. Individuals performing administrative and IT support functions.
  5. Authorized personnel of Atain’s service providers, including:
  • Carrier builder which hosts and supports Atain’s recruitments;
  • Companies contracted to perform background screenings, where applicable. These companies may be based in another country and will be subject to the transfer safeguards mentioned above, and may obtain data from other countries where you have lived, worked or studied, as may be relevant as part of a background check. You will receive more information about any such check before it begins;
  • Government officials where legal reporting requirements may exist, or law enforcement agencies or private litigants in response to valid law enforcement process (warrant, subpoena, or court order); and
  • A successor to Atain in the event that it sells or divests all or part of its business.
How long will Atain retain your personal data?

We seek to ensure that we only keep your personal data for the longest of:

  • the period necessary for the relevant activity or services which is at least 24 months under our contractual arrangements;
  • any retention period that is required by law; or
  • the period in which litigation or investigations might arise in respect of the services.

Atain has in place a Data Retention Policy and Retention Schedule; on joining Atain we will supply you with such policies for your review.

How Atain protects your personal data?

We use a range of measures to ensure we keep your personal data secure, accurate and up to date. These include but not limited to:

  • education and training to relevant staff to ensure they are aware of our privacy obligations when handling personal data;
  • administrative and technical controls to restrict access to personal data to a ‘need to know’ basis;
  • technological security measures, including fire walls, encryption and anti- virus software; and
  • physical security measures, such as security passes to access our premises.

The transmission of data over the internet (including by e-mail) is never completely secure. So although we use appropriate measures to try to protect personal data, we cannot guarantee the security of data transmitted to us or by us.

Atain has in place an Information Security Policy; on joining Atain we will supply you with such policies for your review.

Changes to this Privacy Policy

We may modify or amend this Privacy Policy from time to time at our discretion. When we make changes to this policy, we will amend the revision date at the top of this page and such modified or amended privacy policy shall be effective as to you and your information as of that revision date. We encourage you to review this Privacy Policy periodically to be informed about how we are protecting your personal data.
